Welcome to Keen & Green Landscaping’s Agreement Terms page! We believe in transparency and want our customers to feel confident and informed about our services. Here, you’ll find a clear overview of our agreements, including warranties, responsibilities, payment terms, and more. Understanding these terms ensures a smooth and satisfactory experience for both parties. If you have any questions or need further clarification, don’t hesitate to reach out to us. General Conditions:

  • Keen & Green agrees to supply goods and services outlined in the Scope of Work.
  • Work will conform to local codes and regulations.
  • Keen & Green is insured for liability and property damage.
  • Incidents resulting in damage or injury must be reported promptly.
  • Keen & Green will restore any property damaged during the project.
  • Both parties can terminate the contract with a 60-day notice.
  • Changes to the project specifications require mutual agreement and written documentation.
  • Keen & Green reserves the right to substitute materials of equal or greater quality.
  • Keen & Green may charge for material delivery beyond the scope of work.
  • Satisfaction is guaranteed, and any dissatisfaction must be reported within 14 days for resolution.

Responsibilities:

  • Keen & Green will provide all labor, equipment, and services necessary for the project.
  • Keen & Green will comply with laws, regulations, and obtain necessary permits.
  • If circumstances beyond Keen & Green’s control delay the project, the timeline will be extended accordingly.
  • If access to the work area is denied, the customer must still pay for completed work.
  • The agreement and any amendments constitute the entire agreement between the parties.

Indemnification:

Keen & Green agrees to indemnify the customer for damages caused during landscaping services, except where damages are not due to negligence or breach of the agreement.

Notices:

All notices must be in writing and delivered personally or by fax or email.

Plant and Sod Warranty Clause:

Newly installed plants and sod are covered by a one-year warranty, contingent upon adherence to a watering plan provided by Keen & Green.

Hardscape Warranty Clause:

Hardscape applications are warrantied for three years, covering damages within Keen & Green’s control.

Subcontracting:

Keen & Green may subcontract aspects of the project but remains responsible for its completion.

Records:

Keen & Green will maintain accurate records of the project, accessible to the customer upon request.

Force Majeure:

Neither party is liable for delays or failure to perform due to unforeseen circumstances beyond their control.

Suspension of Work:

Keen & Green may suspend work if necessary circumstances arise, with the customer responsible for associated costs.

Completion Deadline:

The deadline for the project completion is specified as TBD (estimated two weeks from start to finish), with a start date of May 15th pending quote acceptance.

Cost of Services:

The total price is provided, along with an invoice structure and payment schedule.

Signatures:

The agreement is signed by the owner of Keen & Green Landscaping and an authorized representative of the customer.

Overall, this agreement covers various aspects of the project, responsibilities, warranties, and payment terms, providing clarity and protection for both parties involved.
